| 内容記述 | 2013年に導入された刑の一部執行猶予制度は、懲役刑または禁錮刑が3年以下の場合に、その一部を猶予する制度である。この制度は、一定期間、再犯を防止する心理的抑止力を維持し、保護観察下で積極的な指導・支援を行い、施設内処遇と社会内処遇を有機的に結びつけることで、犯罪者の更生を促進することを目的としている。しかし、この制度の導入に伴い、一部執行猶予を含む刑の重さの比較について問題が生じている。一部執行猶予となった刑の重さの関係が複雑になり、いずれの刑が重いかを直ちに判断することが難しくなっている。受刑者の処遇の観点から見ると、刑の一部執行猶予制度は再犯防止と更生に寄与することが期待される。しかし、刑の重さの比較に複雑さをもたらすことから、その有効性と公平性の観点から解決すべき問題と言える。法の下の平等や上訴における刑の不利益変更の禁止という法律的問題の他に、刑罰が行為者の行動に与える影響に関係するため、法と心理学において重要な問題である。 | |||||

However, introducing this system has raised issues regarding comparing the severity of sentences, including those partially suspended. The relationship between the severity of sentences that are partially suspended has become complex, making it difficult to determine which sentence is heavier immediately. In the context of criminal law, the partial suspension of imprisonment system aims to contribute to the prevention of reoffending and the rehabilitation of offenders. However, the complexity it introduces in comparing sentence severity raises questions about its effectiveness and fairness. These are essential considerations in law and psychology, as they relate to the principles of justice and the impact of punishment on offender behavior. | |||||
