| 内容記述 | 日本の国会で成立する法案の中には、一定期間後にその内容を見直すことを求める、いわゆる「見直し条項」が含まれることが多くなってきている。見直し条項は、法案成立をめぐる与野党の政治的妥協の産物であると一般的に考えられてきた。それに対して本稿では、将来における法律の修正と廃止をスムースに促すための、政策デザインのツールとして見直し条項を再評価する。さらに、日本における利用状況およびその利用を促す要因についての検討を行うことによって、見直し条項が政治的妥協の手段というよりも、むしろ政策デザインのための方法として用いられている傾向があることを明らかにする。There has been increasingly widespread adoption of “re-examination provisions,” which require legislators to review the content of legislation after a certain period of time, to bills enacted by the Japanese Diet. The attachment of re-examination provisions has been considered as a product of political compromise between the ruling party and opposition parties. This article, contrary to this common belief, reassesses re-examination provisions as an effective tool for policy design to facilitate policy termination. By examining the factors that affect the adoption of reexamination provisions, the author indicates that there is a tendency of re-examination provisions to be employed as a policy design tool rather than the way for political compromise. | |||||
