| 内容記述 | The penal reform of Emperor Wen of the Western or Former Han Dynasty is one of the most famous reforms of the Han Dynasty. It abolished corporal punishment and put forward a fixed term of penal labor, which is of great significance to the study of the legal history of the Qin and Han Dynasties and even the legal history of China. There is much prior research on the reform of the penal system of Emperor Wen of the Han Dynasty, but there has yet to be a thorough literature review. This paper organizes previous research and combines it with historical materials and unearthed data on the Qin and Han dynasties' penalty system, the content of Emperor Wen's reforms, the situation after the reform of the punishment system, and the reasons for Emperor Wen's reform of the punishment system. | |||||
