| 内容記述 | 2019年までに裁判員制度に関連して日本国内で発表された日本語の心理学的研究を概観するために、文献レビューを行った。情報源としてCiNii、Google Booksのほか、関連する心理学の学術誌の目次、および論文集として出版された書籍を目視して検索した。その結果、193件の文献がピックアップされた。本稿ではその内容をKJ法により類似のテーマを抽出し、主な文献についての内容の紹介を行った。内容のカテゴリーとして、裁判員制度に関する総論的考察の他、裁判員の個人差変数、裁判員の個人判断、法廷技術と法廷戦略、評議などがあった。個人差変数に含まれる研究テーマとして、裁判員制度への社会的態度、参加の意欲、パーソナリティの関係、裁判員の法的・心理学的知識との関係があった。裁判員の判断に関しては、提示された情報、目撃証言、鑑定、感情と判断、残酷な証拠、報道の影響、被害者参加、確信度等との関係を見る研究があった。 | |||||

| 内容記述 | In this paper, the author reviewed the Japanese literature on psychological studies concerning the saiban-in system up to 2019. The author utilized CiNii and Google Books as sources of information, and visually searched the table of contents of related Japanese psychological journals and books published as a collection of papers. As a result, 193 documents were picked up. The author extracted common themes within the literature using the KJ method and summarized the contents of the literature in primary concern. The content categories included general consideration of the saiban-in system, variables of individual differences among citizen participants of the system, the individual judgment of the citizens, court strategy of advocates, and deliberations. The research themes included in the individual difference variables were social attitudes toward the saiban-in system, willingness in participation, personality, and citizen participants' legal and psychological knowledge. Regarding the judgments of the citizens, there were studies that investigated the effects of the information presented in the court, eyewitness testimony, appraisal, emotion and judgment, cruel evidence, the influence of the press, victim participation, certainty, and other related factors. | |||||
