| 内容記述 | 2023年1月から、台湾では「国民法官制度」が始まった。これは、日本の裁判員制度に範をとった、刑事裁判に対する直接的な市民参加制度である。「国民法官」とは、日本語では「国民裁判官」という意味になる。本稿は、国民法官制度の実施において中心的役割を果たす、中華民国の司法院に対して、制度開始から9ヶ月間の実施状況について聞き取りを行った。具体的には、国民法官制度でどのような事件が裁かれたのか、訴訟指揮上の問題はあったのか、国民法官が公判中に適切な質問ができたか、辞退率・免除率、審理時間、休憩の頻度、マスコミ報道、国民法官制度導入や実施に関連する心理学的知見の導入などである。これらの質問に司法院の職員の方は真摯に答えてくださり、国民法官制度の初期の実施状況について知ることができた。制度導入や実施の課程においてはすでに先行して裁判員制度を実施している日本にとっても参考になるところがある。 | |||||

| 内容記述 | Since January 2023, Taiwan has initiated the "National Lay Judge System,” inspired by Japan’s saiban-in system. This system allows direct citizen participation in criminal trials, with “National Lay Judges” serving a role similar to that of saiban-in in Japan. This paper investigates the implementation of the Taiwanese system, focusing on its operation within the Judicial Yuan of the Republic of China over the first nine months. Specifically, it examines the types of cases adjudicated under this system, procedural issues encountered, and the effectiveness of national lay judges in asking pertinent questions during trials. It also examines various metrics such as recusal and exemption rates, trial durations, frequency of breaks, media coverage, and the integration of psychological insights related to the introduction and operation of the system. Responses from Judicial Yuan officials provide a sincere overview of the system’s early implementation phase, offering insights that could be beneficial to Japan, which has previously implemented a similar system. | |||||
