| 内容記述 | In Japan the juvenile crime rate is low and in the United States it is high. It is not due to their juvenile justice systems but due primarily to socio-cultural differences in the larger society. ① In Japan informal social control is exceptionally weighty and effective compared with most other developed societies. ② The Japanese believe in their criminal justice system. Because they do, it works better. And because it works better, they believe in it more strongly. We have here a sort of institutionalized self-fulfilling prophecy. ③ The treatability of humam beings is a kind of self-fulfilling prophecy, too. Japanese culture takes a more benign and optimistic view of human nature and of the possibility of restoring to conformity people who have strayed than does Western society. Our culture premises that criminals can be rehabilitated through the interactional process; criminal's self-denunciation, confession and apology→other's (or audience's) forgivenses→rehabilitation motivated by the feeling of indebtednss for leniency and forgiveness. | |||||

| 内容記述 | 日本の少年犯罪率が米国に比べて低いのは，両国における少年司法制度の違いによるのではなく，社会＝文化的差異による。①社会統制に占めるインフォーマル統制とフォーマル統制との割合の違い―日本では前者のウェイトが非常に大きい。②フォーマル統制とインフォーマル統制との関係のあり方の相違―日本では公と私が融合しており，市民の公的統制機関に対する態度は非常に協力的である。③人間観・矯正可能性についての背後仮説の相違―日本文化には，「神から呪われた民」といった人間観は存在しないし，また，犯罪者は更生できるものだとの文化的前提がある。つまり，犯罪者の側の自首・自白・謝罪→他者の側の許し→許されたことへの負債感をテコにした犯罪者の更生，という儀式化された更生への相互作用過程が想定されている。 | |||||
