But, several faults in this system have been pointed out. A renewed legal system of guardianship for adults intends to improve the faults of the interdiction system and then better protect the life and property of frail adults. Herewith, the issues of diagnosing mental disorders and assessing the psychological capacity of frail adults for psychiatrists raises an interest in a renewal of the guardianship system. In this study, a review of the evaluation of mental disorders and psychological capacity was performed. We concluded that more prudent evaluation is necessary for indication of \"irresponsibility\" and \"incapacity\" in a renewed system.
