| 内容記述 | 標準化は消費者にとって有益なので、競争法上、好意的に取り扱われる。標準化を成功させるためにはホールドアップ行為の防止が不可欠であり、標準化団体（SSO）は、RAND（ライセンスの合理的かつ無差別条件）設定にとどまらず、IPの事前開示とロイヤルティ上限設定をメンバー企業と取り決める必要がある。ただし、競争法違反を避けるため、メンバー間の競争の余地を最大限に確保することがSSOに求められる。Competition laws generally treat favorably business conduct concering standardization. For successfully concluding standardization, it is imperative to block hold-ups. For this objective, standard setting organizations (SSOs)need to obligate their member companies not only to promise RAND(Reasonable and Non-discriminatory)licensing conditions,but also to pre-disclose their IPs,together with promise of maximum royalty. At the same time, SSOs should endeavor to make ample room for members' competition,in order to avoid being found engaging in illegal collusion by competition agencies and courts. | |||||
